M\u00fclkiyeti Muhafaza Kayd\u0131 \u0130le Sat\u0131\u015f Nedir?<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Menkul(ta\u015f\u0131n\u0131r) bir mal\u0131n ba\u015fkas\u0131na devri yap\u0131l\u0131rken, devri yapan ki\u015fi mal\u0131n m\u00fclkiyetinin kendisinde kalmas\u0131n\u0131 sa\u011flamak isterse \u2018\u2019m\u00fclkiyeti muhafaza kayd\u0131 ile sat\u0131\u015f s\u00f6zle\u015fmesi\u2019\u2019 yap\u0131lmal\u0131d\u0131r. B\u00f6yle bir durumu sa\u011flamak i\u00e7in s\u00f6zle\u015fme ile yap\u0131lan sat\u0131\u015fa da m\u00fclkiyeti muhafaza kayd\u0131yla sat\u0131\u015f ismi verilir. M\u00fclkiyeti muhafaza kayd\u0131yla sat\u0131\u015f s\u00f6zle\u015fmesi, bir sat\u0131\u015f s\u00f6zle\u015fmesi dolay\u0131s\u0131yla al\u0131c\u0131ya teslim edilen mal \u00fczerinde bir \u015fart\u0131n ger\u00e7ekle\u015fmesine kadar -sat\u0131\u015f bedelinin tamam\u0131 al\u0131c\u0131 taraf\u0131ndan sat\u0131c\u0131ya \u00f6denene kadar- sat\u0131c\u0131n\u0131n m\u00fclkiyetinin devam etmesi hususunda taraflar\u0131n anla\u015fmas\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2-mulkiyeti-muhafaza-kaydi-ile-satisin-sartlari-nelerdir\">2. M\u00fclkiyeti Muhafaza Kayd\u0131 \u0130le Sat\u0131\u015f\u0131n \u015eartlar\u0131 Nelerdir?<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">S\u00f6z konusu sat\u0131\u015f\u0131n ge\u00e7erli say\u0131lmas\u0131, s\u00f6zle\u015fmenin al\u0131c\u0131n\u0131n ikametg\u00e2h\u0131ndaki noterlik\u00e7e onanmas\u0131 ve \u00f6zel k\u00fct\u00fc\u011f\u00fcne kaydedilmesiyle m\u00fcmk\u00fcn olur. Ancak bu noktada belirtmek gerekir ki; hayvan ve ta\u015f\u0131nmaz sat\u0131\u015flar\u0131nda m\u00fclkiyeti muhafaza kayd\u0131yla sat\u0131\u015f s\u00f6zle\u015fmesi yap\u0131lamaz. Bu s\u00f6zle\u015fme yaln\u0131zca ta\u015f\u0131n\u0131rlar i\u00e7in yap\u0131labilir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Kanuni D\u00fczenlemeyi \u0130nceleyecek Olursak:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">4721 say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4721.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">TMK<\/a>, MADDE 764-a. Ba\u015fkas\u0131na devredilen bir mal\u0131n m\u00fclkiyetinin sakl\u0131 tutulmas\u0131 kayd\u0131, ancak resmi \u015fekilde yap\u0131lacak s\u00f6zle\u015fmenin devralan\u0131n yerle\u015fim yeri noterli\u011finde \u00f6zel siciline kaydedilmesiyle ge\u00e7erli olur. Hayvan sat\u0131\u015flar\u0131nda m\u00fclkiyeti sakl\u0131 tutma s\u00f6zle\u015fmesi yap\u0131lamaz.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">b. Taksitle sat\u0131\u015f\/ MADDE 765- Taksitle mal satan kimse, bu sat\u0131mlara ili\u015fkin \u00f6zel h\u00fck\u00fcmlere uymak ko\u015fuluyla, m\u00fclkiyeti sakl\u0131 tutma s\u00f6zle\u015fmesine dayanarak, satt\u0131\u011f\u0131 mal\u0131n geri verilmesini isteyebilir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">6098 say\u0131l\u0131 TBK MADDE 253- Taksitle sat\u0131\u015f, sat\u0131c\u0131n\u0131n, sat\u0131lan ta\u015f\u0131n\u0131r\u0131 al\u0131c\u0131ya sat\u0131\u015f bedelinin \u00f6denmesinden \u00f6nce teslim etmeyi, al\u0131c\u0131n\u0131n da sat\u0131\u015f bedelini k\u0131s\u0131m k\u0131s\u0131m \u00f6demeyi \u00fcstlendikleri sat\u0131\u015ft\u0131r. Taksitle sat\u0131\u015f s\u00f6zle\u015fmesi, yaz\u0131l\u0131 \u015fekilde yap\u0131lmad\u0131k\u00e7a ge\u00e7erli olmaz. Mal\u0131n sat\u0131c\u0131n\u0131n ticari faaliyeti kapsam\u0131nda sat\u0131lmas\u0131 h\u00e2linde, s\u00f6zle\u015fmede a\u015fa\u011f\u0131daki hususlar belirtilir:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>1. Taraflar\u0131n ad\u0131 ve yerle\u015fim yeri.<\/li><li>2. Sat\u0131\u015f\u0131n konusu.<\/li><li>3. Sat\u0131lan\u0131n pe\u015fin sat\u0131\u015f bedeli.<\/li><li>4. Taksitle \u00f6deme sebebiyle belirtilecek ilave bedel.<\/li><li>5. Toplam sat\u0131\u015f bedeli.<\/li><li>6. Al\u0131c\u0131n\u0131n nakden veya aynen \u00fcstlendi\u011fi di\u011fer b\u00fct\u00fcn edimler.<\/li><li>7. Pe\u015finat ve taksitlerin tutar\u0131 ile vadesi ve ikiden az olmamak \u00fczere taksit say\u0131s\u0131.<\/li><\/ul>\n\n\n\n<p class=\"has-black-color has-text-color\">M\u00fclkiyeti sakl\u0131 tutma s\u00f6zle\u015fmesine genellikle taksitle sat\u0131\u015fta (TBK 253 v.d.) rastlanmaktad\u0131r. Sat\u0131c\u0131 ta\u015f\u0131n\u0131r mal\u0131n\u0131 bu kay\u0131tla satt\u0131\u011f\u0131 takdirde, mal\u0131 al\u0131c\u0131ya teslim etse dahi mal\u0131n m\u00fclkiyetini kendisinde saklamaktad\u0131r. Mal\u0131n m\u00fclkiyetinin sat\u0131c\u0131da kalmaya devam ediyor olmas\u0131 ile de, mal bedelinin al\u0131c\u0131 taraf\u0131ndan \u00f6denmemesi riskine kar\u015f\u0131 sat\u0131c\u0131 lehine bir nevi teminat i\u015flevi g\u00f6rmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3-mulkiyeti-muhafaza-kaydiyla-satilan-mallarin-haczi-mumkun-mudur\">3.M\u00fclkiyeti Muhafaza Kayd\u0131yla Sat\u0131lan Mallar\u0131n Haczi M\u00fcmk\u00fcn M\u00fcd\u00fcr?<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">E\u011fer bir ara\u00e7 m\u00fclkiyeti muhafaza kayd\u0131 ile al\u0131nm\u0131\u015fsa ve bu arac\u0131n trafik kayd\u0131na al\u0131c\u0131 kimsenin alacakl\u0131s\u0131 taraf\u0131ndan haciz konulmu\u015fsa, sat\u0131c\u0131 istihkak iddias\u0131nda bulunabilir. Fakat bu iddiada bulunabilmek baz\u0131 \u015fartlara ba\u011flanm\u0131\u015ft\u0131r. Taksitlerin \u00f6denmesinde temerr\u00fcde d\u00fc\u015f\u00fclmesi ve bundan dolay\u0131 sat\u0131c\u0131n\u0131n fesih hakk\u0131n\u0131 kullanmas\u0131 y\u00f6n\u00fcnde olan iki \u015fart bir arada olmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">M\u00fclkiyeti muhafaza kayd\u0131 s\u00f6zle\u015fmesindeki al\u0131c\u0131 taksitleri \u00f6dememi\u015f ve temerr\u00fcde d\u00fc\u015fm\u00fc\u015f ise m\u00fclkiyet hen\u00fcz al\u0131c\u0131ya-(bor\u00e7luya) ge\u00e7meyece\u011finden ve sat\u0131c\u0131 s\u00f6zle\u015fmeyi feshederek ald\u0131klar\u0131n\u0131 iade edece\u011fine ili\u015fkin se\u00e7ene\u011fi ileri s\u00fcrmemi\u015f ise bu durumda daval\u0131 takip alacakl\u0131s\u0131 ancak \u00f6denmeyen taksitleri sat\u0131c\u0131ya \u00f6deyerek ara\u00e7lar\u0131n m\u00fclkiyetinin bor\u00e7luya ge\u00e7i\u015fini sa\u011flad\u0131ktan sonra s\u00f6zle\u015fme konusu ara\u00e7lar\u0131n haczini ve sat\u0131\u015f\u0131n\u0131 isteyebilir. Bu halde; istihkak davas\u0131 tarihi itibariyle a\u015famalara ili\u015fkin \u0130stinaf Mahkemesi Karar\u0131 uygulamas\u0131 \u015fu \u015fekildedir;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>Konya BAM 7. HD. E.2020 \/ 194 K.2020 \/ 271 T.12.02.2020<\/strong><\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>\u2018\u2019 \u00d6ncelikle &#8220;m\u00fclkiyeti muhafaza kayd\u0131 s\u00f6zle\u015fmesinde belirtilen senedin tamam\u0131n\u0131n bor\u00e7lu al\u0131c\u0131 taraf\u0131ndan \u00f6denip \u00f6denmedi\u011finin ara\u015ft\u0131r\u0131larak arac\u0131n m\u00fclkiyetinin al\u0131c\u0131ya ge\u00e7ip ge\u00e7medi\u011finin de\u011ferlendirilmesi,<\/li><li>Senet bedeli \u00f6denmemi\u015fse; sat\u0131c\u0131n\u0131n fesih hakk\u0131n\u0131 kullan\u0131p kullanmayaca\u011f\u0131n\u0131n tespit edilmesi,<\/li><li>Sat\u0131c\u0131 fesih hakk\u0131n\u0131 kullanmak isterse; bu durumda herkes ald\u0131\u011f\u0131n\u0131 geri vermekle y\u00fck\u00fcml\u00fc olaca\u011f\u0131ndan, sat\u0131c\u0131n\u0131n pe\u015fin ald\u0131\u011f\u0131 bedeli icra dosyas\u0131na yat\u0131rmas\u0131 i\u00e7in s\u00fcre verilmesi, ( arac\u0131n trafik kayd\u0131nda ba\u015fkaca hacizler oldu\u011fu da g\u00f6zetilerek s\u0131ra cetveli yap\u0131lmak \u00fczere), verilen s\u00fcre i\u00e7erisinde paran\u0131n icra veznesine depo edilmesi halinde arac\u0131n m\u00fclkiyet durumu tespit edilerek sonuca g\u00f6re karar verilmesi yine sat\u0131c\u0131 fesih hakk\u0131n\u0131 kullanmak istememesi halinde ise; bu durumda haciz koyduran takip alacakl\u0131s\u0131na s\u00f6zle\u015fme gere\u011fi \u00f6denmesi gereken bakiye borcu sat\u0131c\u0131ya \u00f6demek \u00fczere mahkeme veznesine depo etmesi i\u00e7in mehil verilmesi ve bu bedelin mahkeme veznesine verilen s\u00fcre i\u00e7erisinde depo edilip edilmemesi durumlar\u0131nda olu\u015facak sonuca g\u00f6re (m\u00fclkiyeti muhafaza kay\u0131tl\u0131 s\u00f6zle\u015fmesinin feshinin ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011fi, arac\u0131n m\u00fclkiyeti kime ait olaca\u011f\u0131) bir karar verilmesi gerekir. \u2018\u2019<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4-mulkiyeti-muhafaza-kaydiyla-satilan-mallarin-tekrar-satisi-olur-mu\">4. M\u00fclkiyeti Muhafaza Kayd\u0131yla Sat\u0131lan Mallar\u0131n Tekrar Sat\u0131\u015f\u0131 Olur Mu?<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">M\u00fclkiyeti muhafaza kayd\u0131yla sat\u0131\u015f s\u00f6zle\u015fmesi s\u00f6z konusu ise, al\u0131c\u0131 sat\u0131\u015f bedeli ile olan taksitleri vadeleri geldi\u011finde \u00f6d\u00fcyorsa, alacakl\u0131, ilgili mal\u0131n haczedilip sat\u0131lmas\u0131 talebinde bulunamaz. Al\u0131c\u0131 ki\u015fi mal\u0131n sat\u0131\u015f bedelini vade zaman\u0131nda \u00f6deyemez hale gelirse bu durumda sat\u0131c\u0131 ki\u015fi s\u00f6zle\u015fmeyi feshedebilir. Fesih halinde \u00f6nceden \u00f6denen taksitler iade edilir. Bunun d\u0131\u015f\u0131nda sat\u0131\u015f\u0131n iptali i\u00e7in dava a\u00e7mak da m\u00fcmk\u00fcnd\u00fcr. Dava a\u00e7\u0131lacaksa, gidilmesi gereken mercii aksine bir d\u00fczenleme olmad\u0131k\u00e7a Asliye Hukuk Mahkemesi\u2019dir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Di\u011fer yandan sat\u0131c\u0131, al\u0131c\u0131ya kar\u015f\u0131 ke\u015fide edece\u011fi fesih ihbarnamesiyle makul bir s\u00fcre vererek g\u00f6sterece\u011fi adrese arac\u0131n iadesini istemelidir. \u0130adenin ger\u00e7ekle\u015fmemesi halinde Ceza Muhakemesi Kanunu md. 158 ve T\u00fcrk Ceza Kanunu md. 155\/1 uyar\u0131nca \u015fik\u00e2yette bulunarak su\u00e7a konu ara\u00e7 y\u00f6n\u00fcnden de yakalama karar\u0131 talep edebilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"5-mulkiyeti-muhafaza-kaydiyla-satisi-yapilmis-ve-bu-arac-ile-bir-kaza-meydana-gelmisse-durum-ne-olacaktir\">5. M\u00fclkiyeti Muhafaza Kayd\u0131yla Sat\u0131\u015f\u0131 Yap\u0131lm\u0131\u015f Ve Bu Ara\u00e7 \u0130le Bir Kaza Meydana Gelmi\u015fse Durum Ne Olacakt\u0131r?<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Karayollar\u0131 trafik Kanunu m\u00fclkiyeti muhafaza kayd\u0131yla arac\u0131 sat\u0131n alan ki\u015finin \u201ci\u015fleten\u201d say\u0131ld\u0131\u011f\u0131n\u0131 h\u00fck\u00fcm alt\u0131na alm\u0131\u015ft\u0131r. Bu durumda, arac\u0131 m\u00fclkiyeti muhafaza kayd\u0131yla sat\u0131\u015f<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">yapan ki\u015finin sorumlulu\u011fu ortadan kalkmakta; arac\u0131 sat\u0131n alan ki\u015fi kazadan sorumlu olmaktad\u0131r. \u0130lgili Yarg\u0131tay Karar\u0131 \u015fu \u015fekildedir:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Yarg\u0131tay 17. Hukuk Dairesi E. 2010\/4956 K. 2010\/7486 T. 30.9.2010<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u2018\u2019 Bu durumda mahkemece olay tarihinde arac\u0131n i\u015fleteninin ara\u00e7 m\u00fclkiyeti muhafaza kayd\u0131 ile sat\u0131n alan daval\u0131 H. E. olmas\u0131 daval\u0131 H. T.\u2019\u0131n i\u015fleten s\u0131fat\u0131 ve hukuki sorumlulu\u011funun bulunmamas\u0131 g\u00f6zetilerek daval\u0131 H. T. hakk\u0131ndaki davan\u0131n husumet sebebiyle reddine karar verilmesi gerekirken yaz\u0131l\u0131 oldu\u011fu bi\u00e7imde h\u00fck\u00fcm kurulmas\u0131 do\u011fru g\u00f6r\u00fclmemi\u015ftir.
