How Long Does a Divorce Case Take?
Divorce cases fall into two categories: uncontested and contested. In uncontested divorce cases resolved in a single hearing, the total duration for finalization, as determined by the Ministry of Justice, is 40 days. The time required for the divorce decree to be recorded in the civil registry is 7 days. For uncontested divorce cases, a court date is scheduled for the parties as soon as possible. In contested divorce cases, however, it is not possible to specify a fixed duration. This is because numerous factors—such as the number of witnesses the parties wish to call, whether witnesses can be present on the hearing date, whether an expert examination is required, and whether a social investigation report is needed if there are minor children and custody is sought—can either extend or shorten the duration of the case. Statistics for 2021 also show that a divorce case filed in family court lasted an average of 196 days. It would not be inaccurate to say that this average is lowered because uncontested divorce cases tend to proceed more quickly.

Divorce Statistics

An analysis of the statistics published for 2021 shows that 50.1% of the divorce cases filed were uncontested, while 47.5% were contested.

The crude marriage rate is defined as the number of marriages per 1,000 people. The province with the highest crude divorce rate in 2020 was Antalya, at 2.47 per thousand. It was followed by İzmir at 2.45 per thousand and Muğla at 2.40 per thousand. The province with the lowest crude divorce rate was Hakkari, at 0.24 per thousand.

When the number of divorces is examined by month, a significant decrease was observed in April and May 2020 due to the pandemic. While the number of divorces was 14,496 in April 2019, it decreased by 96.1% to 562 in the same month of 2020; similarly, while it was 14,555 in May 2019, it decreased by 96.2% to 548 in the same month of 2020. On the other hand, an increase in the number of divorces was observed in July 2020 compared to the previous year. The number of divorces, which was 13,555 in July 2019, increased by 69.9% to 23,025 in the same month of 2020.
In 2020, 35.3% of divorces occurred within the first five years of marriage, while 20.7% occurred between the sixth and tenth years of marriage.
