The legal profession is a liberal profession. Legal fees represent the amount or value paid for a lawyer's legal assistance. Lawyers offer their knowledge and experience in the legal field for the benefit of individuals. As with any profession, legal advice and other legal services in the legal profession are subject to fees.
Since the legislator has stipulated that legal aid must be for a fee, and only free legal aid is permitted as an exception, there is a prohibition against accepting cases for free. Acting otherwise constitutes a violation of legal regulations, as well as unfair competition and advertising prohibitions. If such a situation is detected, it must be reported to the bar association's disciplinary board. Furthermore, disciplinary proceedings will be initiated by the relevant bar association against the lawyer who committed the disciplinary offense. In cases where the bar association's disciplinary boards found fee agreements signed by lawyers for free or below the minimum rate, based on pity, helpfulness, or claiming it was a group project, to be unconvincing and insincere, disciplinary action has been taken against the lawyers in question.
It should also be noted that court costs, such as fees for court orders, notifications, inspections, expert witness fees, etc., as well as travel and accommodation expenses incurred by the lawyer for handling the case, are not included in the lawyer's fees. In cases such as losing the case, withdrawing from the case, or the lawyer being removed from their duties, there is no question of a refund of the fees paid.
